The following information was taken from the EPISD Board Minutes. I have just used the employee’s initials. This information is required to foster Transparency in the district’s dealings with its employees. What is the EEOC? It is a federal agency that enforces the following laws.
It is illegal to discriminate because of a person’s race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. In addition, it is against the law to discriminate against a person who complains about discrimination, who has filed a charge of discrimination or who has participated in an employment discrimination investigation or lawsuit. Employers are generally covered by EEOC laws if they have at least 15 employees (or 20 employees in the case of age discrimination). Many labor unions and employment agencies fall under the jurisdiction of the EEOC as well.
In short, if the EPISD does not agree with the ruing of the EEOC so to speak then it goes to court. Of course, the taxpayers are paying for the EPISD lawyers that take the case to court. Most of the time the EPISD does not give the results of the court cases they just disappear never to be seen again.
Looking at the checks written in April by the EPISD I found 3 checks written to the following
April 3, 2019 To KBF $148,952
April 3, 2019 To MM $41,215
April 3, 2019 To DDP $26,075
If these are payments that the employees won in court I think the EPISD administration might need to brush up on EEOC law and realize that these are not peons and have to be treated properly not as the administration demands regardless of what is right and lawful.
I wonder how much was spent on the lawyers working for the EPISD. It is no wonder we have to close schools, we have to pay legal loses and salaries!
Taken from EPISD Board Minutes
5. KBF v. El Paso Independent School District, in the County Court at Law Number 5, El Paso County, Texas; Cause No. 2017-DCV-1271; Pursuant to Texas Government Code Section 551.071
6. MM v. El Paso Independent School District, in the District Court of El Paso County, Texas, 327th Judicial District; Cause No. 2017-DCV-0582; Pursuant to Texas Government Code Section 551.071
7. DDP v. El Paso Independent School District, in the U.S. Equal Employment Opportunity Commission, El Paso Area Office; EEOC Charge No. 453- 2016-01308; Pursuant to Texas Government Code Section 551.071
Actually, I thought that if EEOC rules discrimination took place, that enables the employee to take EPSID to court on a civil discrimination case (normally with a jury capable of awarding punitive as well as actual damages), unless EPSID comes up with a satisfactory out of court settlement.
Lot of goddam flushes to pay for their fuck ups. Congress is no different.
You may want to make plans to attend this Tuesday, May 14, City Council Meeting at 9 AM City Council Chambers.
There will be two items discussed that relate to Lost Dog. Item 24.3 is to approve a resolution that formally certifies the election results and recognizes our proposition as law.
The second item is 26.3 that is to create a stakeholder meeting to propose 3 options to pay the PSB and from which fund.
Here is Dr. Rick Bonart’s take on this.
First the $11.3M or more was according to the city webpage, a result of new covenants included in $30M water and sewer revenue bonds. This argument is not valid and was addressed in 1988 in AG Opinion JM-997 that states land declared inexpedient is not encumbered by revenue bonds. The land in question was declared inexpedient in December 13, 2017.
Second the City is a fiduciary for the taxpayer and the City owns the land. The PSB manages the property for purposes of controlling growth as related to water supply. AG Opinion DM444 addresses this issue. The city’s only legal obligation is to repay the original purchase price and costs of maintenance. An ORR revealed the land was purchased in 1955 for $9.27 an acre, as there are roughly 1007 acres in the ordinance then the city must reimburse the PSB $9270.00 not $11.3M. Paying more would not be legal or acting in the best interest of the citizens. To suggest the taxpayer should be responsible for paying the PSB a profit for real estate speculation on property currently owned by the very same taxpayers is lunacy.
It strikes me as particularly hypocritical to charge the tax-payers “fair market value” when the City had no trouble greatly discounting real estate for Great Wolf Lodge, essentially only netting the tax-payer $1.54 per acre. It seems that the tax-payers deserve the same consideration the City would give to an outside entity.
This reminds me of when CC laid a franchise tax onto our water bill for EPWU’s use of city streets. It is equivalent to my charging myself rent to park my car in my own garage and just raised water rates by a few bucks a month because CC didn’t have the integrity to admit they were raising taxes.
It’s not just that Great Wolf was given an option to purchase millions of dollars worth of land for about $20,000. The City also paid Foster a premium price for that land and then turned around and gave him a sweetheart deal on the thousands of acres that he received in the swap.
Not sure where my first comment went, but this needs to be something that is sent to the media ahead of the city Council meeting. Having this information run is as news story might keep them honest.
Robert Francis O’Rourke, aka Beto.
How is a white non-Hispanic male running as Beto on a national platform not an egregious act of cultural appropriation and misrepresentation?
People have had taco stands destroyed because they were not Hispanic, had their dreadlocks cut off because they were not black, suspended from college for wearing Indian costumes at Halloween parties, the list goes on and on.
Yet somehow Robert Francis “Beto” O’Rourke, a white cisgender Irish male who attended Columbia University gets a free pass for his very deliberate and ongoing act of cultural appropriation which has benefitted him to a great degree politically.
I think this angle has been explored ad nauseam. Don’t get me wrong. I think it’s kind of ridiculous. But he has been going by Beto since he was a toddler and the story has been told dozens if not hundreds of times.
Get over it.
I would say the same thing about trump.
He won, get over it.
Besides, beto is done, he is a joke man-baby and now all of America has seen for themselves that all he ever was is an idea of something that doesn’t make sense and luckily never materialized. He has not espoused a single concrete policy position yet thinks he is still running for president. I hope he makes the first debate, that will be hilarious. The sheer narcissism required to run for something without even a modicum of experience is the mark of today’s younger generations.
Name a single piece of major legislation he put forth. And no, we haven’t forgotten that the trolley’s were his (step-father’s) idea. The trolley to nowhere.
Bet, help him find himself 2020 (his words not mine)
Get over that.
Without insults, what do your readers think about the current state of affairs regarding the Constitutional Crisis facing our nation arising from the fighting between branches of government?
What constitutional crisis?
Do you mean Democrats demanding the release of an “unredacted” Mueller report, which by law did not have to be released at all (purely discretionary by AG to release the findings at all), a report that contains grand jury information that cannot be released by anyone without a judge’s order?
That constitutional crisis?
Besides, a 98.5% unredacted version has been available for weeks and not a single Democrat has bothered to read it. Not a single one.
Maybe the “crisis” is that so many hate-filled Democrats have abdicated their sworn oath to serve the country in their quest to overturn the 2016 election.
When everything is a “crisis” nothing is a crisis.
“hate-filled Democrats”? Read your own post. the man asked a question and asked for feedback without insults, but you couldn’t help yourself.

Yet you don’t dispute the facts of the sentence you find problematic. Are you claiming congressional democrat attacks against trump are not due to hatred?
Congressional Democrats have done far more to support Russian interests in the last two years than the actual Russian government. They have literally prevented the legitimate business of America from being undertaken in their hate-filled ragefest tantrum over the 2016 election.
Worse, high-level Democrats use the forces of government against citizens and opponents.
If you are for that then you deserve the same thing in return. Let the IRS take action against you to suppress your political activities and police forces take action against you over accusations that have no proof.
Get you some of that and see how you like it.
mirror, you have to understand that certain cowards can’t resist any opportunity to let their emotions run rampant. They claim to be forced to use a pseudonym because they have a job, but I suspect that if they know enough to know that they need to hide their activities from their employer, they know that there is something wrong with their thinking. So, to make themselves feel better about their cowardly duplicity, they find targets that they think are soft, and easy to hit, as they go their merry way. I knew he/she would be the first to ignore my request to avoid attacking anyone, and sure enough, true to form. The reality is that, like all trumpsters, he/she finds him/herself in an untenable position, so instead of listening to facts, or researching to find facts, they make stuff up, and resort to ad hominem attacks on all and sundry.
I actually believe the post to which you refer cites facts before using the phrase “hate-filled Democrats,” which unfortunately is also true. There are some who remain anonymous and simply rant, but that post was actually a well articulated argument. Personally, I think if the Dems want to win in 2020 they should get back to work. The average American is now starting to realize how much of a witch-hunt this has become. Frank Capra got it right.
I think the Democrats need to focus on closing asylum loopholes and get back to work on finding middle ground in immigration and healthcare. This quest to find a crime to unseat a President they hate needs to end. And if the Obama Administration weaponized intelligence agencies and law enforcement to create an insurance policy or those agencies acted out of political motivation on their own, that does need to be prosecuted by DOJ.
It’s not a crisis. You’ve been watching too much CNN.
Fox News, Fair and Balanced.
Political posturing. The Democrats did not call Eric Holder’s refusal to turn over documents a crisis. Even the upset GOP refrained from the use of “constitutional crisis.” The solution to the problem is term limits. Both parties in Congress are so busy protecting their elected status that they fail to legislate and are beholden to lobbyists for their next election.
“Both parties” is the key phrase. Add to that “both liberals and conservatives.” I’m baffled as to why anyone continues to defend either party. Having to choose between two evils at election time is one thing, but why anyone defends either side is puzzling.
