The email from our former city mangler confirming that city council met in executive session and decided to delay the issuance of the ball park bonds points to another problem.
Texas law allows council to go into executive session for a limited number of reasons.
Discussing bond issuance is not one of the reasons.
Section 551.144 defines the penalty for participating in the closed meeting:
An offense under Subsection (a) is a misdemeanor punishable by:
(1) a fine of not less than $100 or more than $500;
(2) confinement in the county jail for not less than one month or more than six months; or
(3) both the fine and confinement.
I don’t expect that our district attorney will enforce this law.

This may not be the only crime our illustrious DA may have to be sweeping under the rug at City Hall. Seems some one has broken into someone office at City Hall, you know that shining pillar of ethics in the El Paso government. Now let see how long it takes our brilliant local media to get on top of this story. Let just call this one City Hallgate.

It seems that the number of items that need to be discussed in executive session increases daily. And it isn’t just the City Council, the County Commissioners and UMC are guilty of it, too.

If you want to find out what is happening in ex session then file a writ of Mandamus. The Judge will check the recordings and decide if the law was violated.
