The president and entry of aliens

United States Code title 8, section 1182(f):

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

    The legal basis for the President’s action has been there and upheld by various courts over the years. Every President back to Eisenhower has used it including Obama. For the 9th circuit to suddenly decide, based upon social media comments, what is and isn’t in the national interest is just one more example of judicial activism and a deliberate ignorance of the Constitutional principles upon which United States Code title 8, section 1182(f) is based.

      The president has the authority to review vetting standards. That is all the presidential action called for. No proof needed for that. The halt on immigration from the same 6 countries that Obama identified as risky was for 3 months only.

An employment lawyer once told me that in Texas, one can fire an employee for no reason at all, but one must be very careful not to use a bad reason to fire an employee because it will cost you a lot of money. As is so often the case, Trump cut the legal legs out from under those who try to represent him with his misguided talk and tweets. Trump could have been as transformative as Reagan if he had Reagan’s goodwill and energy level and if he could sleep at night
