Please help us understand

Maybe someone familiar with how traffic accidents are handled can explain/justify to us why our freeway had to be closed for almost 20 hours the other day.

It is certainly tragic that people died and others were injured.

The investigation will not bring them back to life.

With video recording equipment being as sophisticated as it is, why is it that pictures could not be taken and analyzed later.

Couldn’t they have cleared the road earlier and done an exhaustive analysis after the fact?

The difference one person can make

I was hoping to see the action when our new city representative questioned the sense in letting the city violate the “dark skies” ordinance at this week’s city council meeting.

The meetings are long and it generally saves time to wait a few days after the meeting so that you can go directly to the item on the video instead of waiting as each item is contemplated.

I did not get to see the lighting ordinance issue.

Instead I got to see something absolutely wonderful.

One of the cellular carriers wanted to get a special variance to install a tower on Montana Avenue.  They needed the variance because the tower would be within 500 feet of another tower.

A citizen addressed the council and objected.  City staff wanted council to approve the variance right away–at the city council meeting.

The citizen pointed out that city staff failed to disclose all of the towers in the area.  Why would they do that?   Is it conceivable that staff does not know where the towers are?  Or is it more probable that they did not want to disclose all of them in the hope that council would not object to just one extra one?

At one point an assistant city attorney cautioned council that by law they only had 150 days to rule on this kind of variance application.  City council needed to take affirmative action at the meeting.

Our new city representative had been asking intelligent questions about the process and the need.  When he heard that there was a 150 day time limit he asked when the process had started.

City staff responded that they did not have a record of when the process started with them.  Thus the 150 day warning was no more or less than a strong arm tactic to fool council into taking their desired action.

Our new city representative suggested a delay until the next meeting and remarkably city council voted in favor of the postponement.

Way to go Mr. Tolbert!  City staff has been misleading council for quite some time.  Your patience and questioning might actually put a stop to it especially if we start disciplining those that lie to council.

EPISD hiring

Here are some interesting facts you might find ‘eyebrow raising:’

1.  In the last five weeks, multiple positions have been filled without advertisement nor interview as required by the Texas Education Code and EPISD Board Policy DC (Legal).  Those positions include, but are not limited to:  Chief School Officer, Chief of Innovation (Academics Division), Chief of Staff, Deputy Superintendent of Finance and Operations and Deputy Superintendent of Administration.  Human Resources targeted by audit for not advertising and interviewing.  Positions are not ‘retitled.’  They are new positions with new responsibilities considered promotions.New Deputy Superintendent of Administration WAS Associate Super for Human Resources and is department is currently on Corrective Action Plan for inappropriate activities at HR.  http://www.episd.org/departments/internal_audit/audit_reports.php   2015-2016 audits…

2.  The person who was appointed Chief of Staff was the same person who started of as a mid-level Director of External Funding, then Senior Researcher then Executive Director then Chief of Staff all within a year and a half.  He is also the person who misread a report and reported to the Board of Trustees that the district would lose $6 million in ADA due to a decrease in population which, it turns out, did not happen.  Reported in September of 2016 by EP Times.  Pay increase over a year and a half:  At least $40,000 but truly unknown because pay level for Chief of Staff is unavailable at EPISD website.

3.  The new Deputy Superintendent of Administration has also received two promotions by appointment over the last two years.  Started off as Executive Director, the Associate Superintendent, now Deputy Superintendent.  No advertisement and no interview, as required by TEC 11.1513 and EPISD Board Policy DC (Legal).  Most recent pay increase:  Approximately $40,000

4.  All elementary and middle school principals met with last week Thursday to inform them of sweeping transfers for them and their staff for 2015-2016.

5.  15 Elementary and Middle School principals met with individually by Superintendent Cabrera and told that their campuses will be closing at end of school year.  Is a done deal.  Principals told that if parents, students or communities from these neighborhood schools are loud in protest or if teachers or others protest, the principal will be terminated for not following the company line on this.  Great level of fear among staff.

Here is the Education Code citation:

Sec. 11.1513.  EMPLOYMENT POLICY.  (a)  The board of trustees of each independent school district shall adopt a policy providing for the employment and duties of district personnel.

(d)  The employment policy must provide that not later than the 10th school day before the date on which a district fills a vacant position for which a certificate or license is required as provided by Section 21.003, other than a position that affects the safety and security of students as determined by the board of trustees, the district must provide to each current district employee:

(1)  notice of the position by posting the position on:

(A)  a bulletin board at:

(i)  a place convenient to the public in the district’s central administrative office; and

(ii)  the central administrative office of each campus in the district during any time the office is open; or

(B)  the district’s Internet website, if the district has a website; and

(2)  a reasonable opportunity to apply for the position.

I fear that we are going to learn that these positions do not require certificates or licenses.

Response to Rookie error?

Item 13.1, which would exempt the City from being required to meet the “dark sky” standards, appeared on the May 17, 2016 agenda. It was merely an introduction of the amendment to the lighting ordinance. The actual vote on the proposal is on the May 31, 2016 agenda – Item 27.1. I will raise objections to it and I will not vote for the amendment.

This particular amendment was just one of several updates to the Building and Construction codes. I was briefed about these updates without mention of specifics. Fortunately, because of the vigilance of Elpasospeak, I was made aware of the nature of this particular amendment.

Government works best when it is transparent and the public is not only informed but vocal. Thank you Elpasospeak.
